1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the website located at cultivoorganics.com and the horticulture consulting services offered by Cultivo Organics LLC ("Company," "we," "us," or "our"). By accessing our Site or purchasing our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site or services.
2. Services
2.1 Description of Services
Cultivo Organics LLC provides bilingual (English and Spanish) horticulture consulting services including virtual plant consultations, in-person garden assessments (in the Inland Empire, California area), written planting plans, soil test interpretation, and related educational content. Our services are intended to provide guidance and recommendations to help you care for your plants and garden.
2.2 Not a Guarantee
Our services provide educational guidance and professional recommendations based on the information you provide to us. We do not guarantee specific results. Plant health and garden outcomes depend on many factors outside our control, including but not limited to local climate and weather conditions, soil quality, water quality, pest pressure, your implementation of our recommendations, and natural variation in plant behavior.
2.3 Scope of Services
Each service tier covers a defined scope as described at the time of booking. Services outside the purchased scope — including additional plants, sessions, or consultations — are not included and will require a separate booking and payment.
3. Booking & Payment
3.1 Booking
Services must be booked in advance through our scheduling system. Bookings are confirmed upon receipt of payment. You will receive a confirmation email with session details and instructions for submitting photos and information prior to your session.
3.2 Payment
Payment is due at the time of booking. We accept payment through the methods listed on our booking page. All prices are listed in US dollars and are subject to change. Any changes to pricing will not affect confirmed bookings.
3.3 Cancellation & Refund Policy
We understand that plans change. Our cancellation policy is as follows:
Cancellations made 48 hours or more before the scheduled session: Full refund
Cancellations made 24 to 48 hours before the scheduled session: 50% refund or option to reschedule once at no charge
Cancellations made less than 24 hours before the scheduled session: No refund; option to reschedule once at a reduced rate
No-shows without prior notice: No refund
To cancel or reschedule, please contact us at info@cultivoorganics.com as soon as possible. Refunds will be processed within 5-10 business days to your original payment method.
3.4 Company Cancellation
We reserve the right to cancel or reschedule a session due to illness, emergency, or other circumstances beyond our control. In such cases, we will contact you as soon as possible and offer a full refund or the option to reschedule at no additional charge.
4. Virtual Sessions
Virtual consultations are conducted via video call (Zoom, Google Meet, or similar platform). You are responsible for having a stable internet connection and a device capable of video calling. We are not responsible for technical difficulties on your end that prevent or interrupt a session. If a session is significantly disrupted due to technical issues on our end, we will offer a complimentary reschedule.
Prior to each session, you agree to submit photos and information about your plants as requested. The quality of our recommendations depends in part on the quality and completeness of the information you provide.
5. In-Person Services
In-person On-Site Assessments are available only in the Inland Empire, California area. By booking an in-person service, you represent that the property is located within our service area and that you have the authority to grant us access to the property. You agree to maintain a safe environment during the visit. We reserve the right to decline or terminate an in-person visit if safety concerns arise.
6. Intellectual Property
6.1 Our Content
All content on our Site — including text, images, blog posts, guides, logos, and brand elements — is the property of Cultivo Organics LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.
6.2 Work Product
Written plans, reports, and recommendations delivered as part of our consulting services are provided for your personal, non-commercial use only. You may not resell, republish, or distribute these materials without our prior written consent. We retain all underlying intellectual property rights in our methodologies, frameworks, and templates.
7. Client Responsibilities
By booking our services, you agree to:
Provide accurate and complete information about your plants, garden, and growing conditions
Submit requested photos and materials prior to your session
Implement recommendations at your own discretion and risk
Consult appropriate professionals (e.g., licensed contractors, soil scientists) for matters outside the scope of horticulture consulting
Use our services only for lawful purposes
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CULTIVO ORGANICS LLC AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO PLANT LOSS, CROP FAILURE, PROPERTY DAMAGE, OR LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
